PDP Leadership Crisis: Maintain Status Quo, Appeal Court Orders Parties

The Court of Appeal, Abuja Division has ordered warring parties in respect of the office of the National Secretary of the Peoples Democratic Party (PDP) to maintain status quo ante bellum pending the determination of a suit on the matter.

A panel of the appellate court led by President, Court of Appeal, Justice Monica Dongban-Mensem, alongside Justices Gamma Barka and Joseph Oyewole gave the order on Monday, January 13, after hearing a motion on notice.

The motion on notice marked CA/E/01m/2025, drawn from Appeal. no: CA/E/24/2024, was filed by the PDP, Amb. Iliya Damagun (Acting National Chairman), for themselves and as Representing the National Executive and Working Committee of PDP.

Respondents in there appeal are Aniagu Emmanuel, Sen. Samuel Anyanwu, and High Chief Ali Odefa (National Vice Chairman South East Zone PDP).

An enrolled order of the motion in possession of Daily Independent showed that it was filed on the 2nd day of January, 2025.

Thee motion prayed for
“AN ORDER STAYING THE EXECUTION of the judgment of this Court in Appeal No: CA/E/24/2024 between Peoples’ Democratic Party & Anor. V. Aniagu Emmanuel & 2 Ors. Delivered on the 20th day of December, 2024 pending the hearing and determination of the appeal filed at the Supreme Court of Nigeria.

“AN ORDER OF INJUNCTION restraining the Respondents, their agents’ privics of otherwise however described from enforcing or giving effect to the judgment of this Court delivered on the 20th day of
December, 2024 pending the hearing and determination of the appeal filed at the Supreme Court.

Upon hearing the Motion on Notice on January 13, and after hearing J. Y. Musa SAN, with Okwudili Anosie Esq and Gregory Ukpong Esq, learned counsel for the Applicants; Paul Erokoro SAN with Michael Ajara Esq and Timileyin Kehinde Esq, learned counsel for the Respondent, K.C. O. Njemanze SAN with Hassan Uthman Esq learned counsel for the 2nd and 3rd Respondents, thee panel made the following orders.

“The Motion for stay of execution of the judgment of this court filed on 2nd January, 2025 is adjourned to the 27th day of January, 2025 for hearing.

“Accordingly, all Parties are enjoined to maintain the status quo ante bellum pending the hearing and the determination of the Motion on Notice” the Court of Appeal ordered.
