The National Industrial Court of Nigeria has faulted Dr. Adekunle Philips Adewuyi, a former lecturer at the Ladoke Akintola University of Technology, Ogbomoso, over his refusal to serve the Institution for four years or pay for four years pursuant to the Bond Agreement dated July 9, 2007, which was mutually executed him and the University.
The Ibadan Judicial Division of the Court, presided by Honorable Justice J.D. Peters also in describing Adewuyi’s action as a breach declared that the Claimant and his Surety are jointly and severally indebted to the LAUTECH in the sum of =N=3,519,137.57 (Three Million, Five Hundred and Nineteen Thousand, One Hundred and Thirty-Seven Naira, Fifty-Seven Kobo) being the amount covering the uncompleted period of two years which the Claimant failed to serve the Institution.
The honorable justice, in delivering judgement in Suit No: NICN/IB/53/2014 ordered and directed Adewuyi who was the claimant in the suit and his Surety, Dr. A.A. Raheem to pay forthwith the sum of =N=3,519,137.57 (Three Million, Five Hundred and Nineteen Thousand, One Hundred and Thirty-Seven Naira, Fifty-Seven Kobo) to LAUTECH (the Defendant), representing 2 years uncompleted period of service pursuant to Bond Agreement.
The Court in declining giving an order, directing the Claimant to pay the sum of =N=2,000,000.00 (Two Million Naira) only to the Defendant for breach of contract, also refused to award the sum of =N=2,000,000.00 (Two Million Naira) only as representing Defendant’s Solicitors’ Fees for the action on the ground that doing so is contrary to public policy.
Justice Peters further in his judgement, refused and dismissed the claim for 21% interest on the Judgment sum from the date of the writ till Judgment is delivered in the suit. He explained however that the total judgement fee of Three million, Five hundred and Nineteen Thousand, One Hundred and Thirty-Seven Naira, Fifty-Seven Kobo (N3, 519,137.57), shall attract interest at the rate of 10 Percent interest per annum from July 19, 2023, when the judgement was delivered, until the entire Judgment sum is finally liquidated.
The Claimant shall pay to the Defendant the cost of this action assessed at Two Hundred Thousand Naira only.
It held that the Judgment shall be complied with within the next 30 days from the judgement day.
